Proposals Not Passing Vote of the Plenary

Following the Convention’s first plenary session, students broke into groups to vote on which of the proposed amendments merited floor debate.  Due to time constraints, only those proposals garnering the support of at least three student committees were eligible for debate and vote.  In addition to the proposals that ultimately passed, the proposals listed below had sufficient student support to move to the convention floor.  Ultimately, however, the delegates did not vote to pass them.

Senate Election - Article 6, section 2.  Senate Districts: Members of the senate shall be elected at large  by the qualified voters of the state through a voting process established by law [RESPECTIVE SENATE DISTRICTS.  THE BOUNDARIES OF THE SENATE DISTRICTS SHALL BE SET UNDER THIS ARTICLE FOLLOWING THE  OFFICIAL REPORTING OF EACH DECENNIAL CENSUS OF THE UNITED STATES]. (Note:   Additional conforming amendments to Article 6 would be required if this amendment is adopted.)

Legalization of Marijuana - The state shall not impose criminal penalties for the possession or cultivation of marijuana for personal use by Alaskans 21 or older. The State shall permit the sale of marijuana for personal use by Alaskans 21 or older through a system established by law. "Personal use" means four ounces or four marijuana plants.

Permanent Fund for Transportation and Renewable Energy - Article 9, section 7.  Dedicated Funds: The legislature shall set aside ten percent of the Permanent Fund income toward transportation and renewable energy.

Public Education and Child Care -  Article 7, section 1.   Public Education: The legislature shall by general law establish and maintain a system of public schools and childcare facilities open to all children of the State, and may provide for other public educational institutions. Schools and institutions so established shall be free from sectarian control. No money shall be paid from public funds for the direct benefit of any religious or other private educational institution.

Health Care - Article 7, Section 4.   Public Health: The legislature shall provide for the promotion and protection of public health. The legislature shall provide health care and health maintenance to all Alaska residents.

Suffrage and Elections - Article 5 Section 2: No person may vote who has been convicted of a felony [INVOLVING MORAL TURPITUDE] unless either his civil rights have been restored or he has been released from confinement. No person may vote who has been judicially determined to be of unsound mind unless the disability has been removed.

Suffrage and Elections - Article 5 Section 6, “Campaign Funding”: The legislature shall establish a public Campaign Finance Fund to cover campaigning costs of declared candidates to State office.

Legislative Qualifications - Qualification of Legislators, Article 2, Section 2.  Members: A member of the legislature shall be a qualified voter who has been a resident of Alaska for at least three years and of the district from which elected for at least one year, immediately preceding his filing for office. [A SENATOR SHALL BE AT LEAST TWENTY-FIVE YEARS OF AGE AND A REPRESENTATIVE AT LEAST TWENTY-ONE YEARS OF AGE.]

Legislative Immunities - Article 2, Section 6.  Immunities: Legislators may not be held to answer before any other tribunal for any statement made in the exercise of their legislative duties while the legislature is in session. [MEMBERS ATTENDING, GOING TO, OR RETURNING FROM LEGISLATIVE SESSIONS ARE NOT SUBJECT TO CIVIL PROCESS AND PRIVILEGED FROM ARREST EXCEPT FOR FELONY OR BREACH OF THE PEACE.]
