Intent of the Proposed Change

  • To separate misuse of Alcohol or Other Intoxicants or Drugs into two categories.  
  • To clarify that legally being under the influence of alcohol is not a violation of the Code unless the student violates another code while they are under the influence of alcohol.  
 

Current Policy

R09.02.020 – J

Examples include:

  1. use, possession, manufacture, distribution, or being under the influence of alcoholic beverages on property owned or controlled by the university or at activities authorized by the university, except as expressly permitted by law, Regents’ Policy, University Regulation, or MAU rules and procedures; or
  2. use, possession, manufacture, distribution, or being under the influence of any narcotic, controlled substance, or intoxicant on property owned or controlled by the university or at activities authorized by the university, except as expressly permitted by law, Regents’ Policy, University Regulation, or MAU rules and procedures.
 

Proposed Revision

Misuse of Alcohol

Examples include:

  1. use, possession, or distribution of alcoholic beverages except as expressly permitted by law, Regents’ Policy, University Regulation, and MAU rules and procedures; or
  2. Violation of any other category of conduct while under the influence of alcohol constitutes a violation of this category.

Misuse of Drugs or Other Intoxicants

Examples include:

  1. Use, possession, or distribution of illegal drugs and other controlled substances except as expressly permitted by law, Regents’ Policy, University Regulation and MAU rules and procedures; or
  2. Abuse or misuse of prescription or over-the-counter medications; or
  3. Violation of any other category of conduct while under the influence of illegal drugs or other intoxicants (including designer drugs) constitutes a violation of this category.
