Liquidated Damages: The payment of a specified sum should one of the parties be in breach of contract. This is meant as a fair representation of losses in situations where actual damages are difficult to ascertain. These liquidated damages are meant to be fair rather than punitive. Forfeiture of Room Reservation A room reservation is considered forfeited when check-in is not completed during the university's published check-in schedule. A forfeited room reservation is subject to all charges specified in the Cancellation and Agreement section of the Housing and Dining Agreement. The amount forfeited constitutes liquidated damages. The parties to the Housing and Dining Agreement acknowledge and agree that it is impractical and difficult to determine the actual damages sustained by the university for the failure of a student to occupy or sustain occupancy in a unit.
