Definitions

Forfeiture: A penalty for the breach of a condition. Liquidated Damages: The payment of a specified sum should one of the parties be in breach of contract. This is meant as a fair representation of losses in situations where actual damages are difficult to ascertain. These liquidated damages are meant to be fair rather than punitive.

Policy

Room Reservation and Assignment Reservations and assignments in UAA's residential community will be made in conformance with the following guidelines:

  • A room will be reserved provided that eligibility requirements are met and a required deposit is made to secure the reservation.

  • Room assignments are made at the discretion of Housing, Dining & Conference Services. Assignments are made based on the information provided in the application form and on the availability of rooms. However, preferences indicated on the application are not guaranteed.

  • Housing, Dining & Conference Services must approve changes to room assignments in advance.

  • The university may assign or reassign students for financial, safety, or behavioral reasons, or without cause. Higher fees may be charged for a reassignment.

  • Roommates are assigned without regard to race, color, religion, national origin, sexual orientation, veteran or disabled veteran status, mental or physical disability, changes in marital status, pregnancy or parenthood.

Forfeiture of Room Reservation A room reservation is considered forfeited when check-in is not completed during the university's published check-in schedule. A forfeited room reservation is subject to all charges specified in the Cancellation and Agreement section of the Housing and Dining Agreement. The amount forfeited constitutes liquidated damages. The parties to the Housing and Dining Agreement acknowledge and agree that it is impractical and difficult to determine the actual damages sustained by the university for the failure of a student to occupy or sustain occupancy in a unit.
